By Molly Crane-Newman, New York Daily NewsNEW YORK — A Manhattan judge on Monday dismissed Donald Trump’s counterclaim against E. Jean Carroll, alleging she defamed him as a rapist after a jury found him liable for sexual abuse. The decision by Judge Lewis Kaplan found that the difference between Carroll’s allegedly defamatory remarks — that Trump “raped” her as defined under New York law — and the jury’s finding that he forcibly digitally penetrated her was “minimal.”“The difference between Ms. Carroll’s allegedly defamatory statements — that Mr. Trump ‘raped’ her as defined in the New York Penal Law — and the ‘truth’ — that Mr. Trump forcibly digitally penetrated Ms. Carroll — is minimal. Both are felonious sex crimes,” Kaplan wrote.“If Ms. Carroll had stated that Mr. Trump ‘raped’ her by forcibly digitally penetrating her vagina instead of referring also (allegedly) to forcible penile penetration, there would have been no different effect on the mind of an average listener.”A jury...Heavy fire spreads through three residential Mattapan buildings

Gerrit Cole didn’t hesitate at the mention of Tommy Kahnle.“Psychopath, that guy,” the Yankees’ ace said before the Daily News could even ask a question. That reaction – along with the ensuing praise for Kahnle – neatly summarizes the prevailing sentiment.Kahnle, on his third stint with the Yankees organization after reuniting with the team over the offseason, is as eccentric as they come in pinstripes. While the Yankee Way is often associated with scrubbed-down and buttoned-up individuals, Kahnle’s free spirit has captured the attention of fans and teammates alike throughout his 13 professional seasons.“I first come in, I probably seem a little over the top,” said Kahnle, who turned 34 on Monday. “But I could tell guys, the more they’re around me, the more they start to kind of like it. It keeps guys loose and they have fun.”After talking to Kahnle and 13 of his past and present teammates, The News compiled a c...Newton triple homicide suspect is not competent to stand trial, judge rules

The second Keynan Middleton realized the Yankees had traded for him, he rushed to the bathroom to shave his face.A seventh-year veteran, the reliever knew about the Yankees’ expectations long before they dealt pitching prospect Juan Carela to the White Sox in exchange for him. “I knew that that wasn’t gonna fly,” Middleton said of his beard.“I was ready to play by their rules because all I want to do is win games and do that however is possible,” Middleton told the Daily News and ESPN on Sunday. “That’s why coming here, looking the part, acting the part, doing the things they tell you to do – there’s just a culture here. You know how to act. You know how to go about your business. You know not to be late. You know there’s consequences if you are late.“Did I want to shave my beard off? Hell no. By Olivia Doak, Daily CameraA new 3-D technology the size of a Scrabble board may be the key to sending physical touch, like holding the hand of a loved one, over long distances.University of Colorado Boulder researchers created a new shape-shifting gadget compact enough to fit on a card table that may be able to digitize touch. The device is made from a grid of robotic parts that can sense outside pressure and can move up, down and around.“As technology has progressed, we started with sending text over long distances, then audio and now video,” said Brian Johnson, one of two lead authors of the study, in a news release. “But we’re still missing touch.”The technology has the potential to send touch digitally by creating 3-D images of a hand, for example. It could then send the image to another device across the country or world, allowing the receiver to hold the sender’s hand. The device can already change its surface, shake a beaker filled with liquid, generate scrolling 3-D text ...VIDEO: Three-legged dog learning to surf at Del Mar Dog Beach

JUNEAU, Alaska (AP) — Raging waters that ate away at riverbanks, destroyed at least two buildings and undermined others were receding Monday in Alaska’s capital city after a glacial dam outburst last weekend, authorities said. Levels along the Mendenhall River had started falling by Sunday but the city said river banks remained unstable. Onlookers gathered on a bridge over the river and along the banks of swollen Mendenhall Lake to take photos and videos Sunday. A home was propped precariously along the eroded river bank as milky-colored water whisked past. There were no reports of any injuries or deaths. The city said it was working to assess damages.Such floods occur when glaciers melt and pour massive amounts of water into nearby lakes. A study released earlier this year found such floods pose a risk to about 15 million people worldwide, more than half of them in India, Pakistan, Peru and China.
